I helped my sister do this and she got back 750 notes.

The nightmare of it is you have to trail back through all your bank statements and list every charge you have had over the past six years and add them up in a table, send this to the bank with your letter.

Statements like this seemed to do the trick....

I now understand that the regime of 'fees' which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations.

Furthermore, I shall submit a Consumer Credit Act 1974 complaint to the OFT upon the basis that you have failed to comply with the OFT's direction of 5 April 2006 and are therefore not a 'fit and proper person' to hold a consumer credit licence under the 1974 Act. If you do not understand what this means then seek advice from your legal department.

Good luck to everyone claiming them back.

It was over 6 years though. At 35 quid a charge from Co op bank it soon adds up.

i max banks can charge pcm is £50, and like mat i felt a bit worried when i saw a prog showing many individuals claiming back over £5000 worth of fees. some ppl are so stupid! the only reason banks pay up is because it is uneconomical for them to go to court.

i doubt it mate! the amount of people that are doing this is immense. anyways if the bank was to treat you unfairly and be a cunt, then theres always the ombudsman you could go too....

You only need to compile a list of the charges in a table, you dont need to present them with all the statements. Well, thats what I did with my sisters anyway. When I helped her do hers, the co op bank wanted £5 a statement, so she signed up for interent banking and we took it all off there.

I'm sure if you write to them explaining why you want them, they will oblige. Just comparing to the way I helped my sister approach it, every bank is diff aren't they. :?

I would say-
first try internet banking and see how far back it goes
If no joy ring and ask, find out how much for copy statements (u never know it might be free)
If its not free and works out expensive, write in explaining why you want them and ask for them free of charge.

if you havent got your statements do this

If one year's statements show £70 of charges then you can estimate the total amount of charges for 6 years will be: £70 x 6 = £420.00
If you have 5 months of statements and these show that you have accumulated £150 of charges in that time, then you can calculate that you have been charged on average £30 a month. (£150 divided by 5 = £30). There are 72 months in six years so 72 x £30 = £2,160.00 (if your account hasn't been open for the past six years then only multiply the average amount by the number of months the account has been open).
Fill in the necessary details in the template for the "estimated charges letter" in the box below and post it Recorded Delivery to your bank/lender's branch address.
Your bank/lender will almost certainly work out how many charges you have actually incurred in the past six years. It may contact you within 14 days to either make you an offer, in part or in full, or to state that it has refused to refund your money. DOWNLOAD THE LETTER

If the claim is small, banks/lenders tend to settle the claim quickly to reduce their legal and administrative costs, but each organisation reacts differently. If the claim is large, then it is more likely the bank/lender will do nothing until a claim is filed at court.
Check online with the Post Office to confirm the date that the lender received your letter and then allow 14 days from that date for it to respond.
If, after 14 days, you have received no response at all, or are unhappy with the bank/lender's response then the next stage is to file a claim at your local small claims court (see section titled 'File at Court' below). There is a fee to file a claim. If your bank pays up, this fee is refunded at the point of settlement.
The lender is then obliged to defend its case before the judge or else to pay the amount you are claiming against it. If it chooses not to defend itself, as well as paying the full amount of your claim, it will also refund your court fee. So far no bank/lender we are aware of has defended its penalty charges in court. (see section titled 'File at Court' below).

I sent print outs (i internet bank) and I highlighted the charges for the last 12 months. then multiplied it by 6 and asked for that much!

Don't quit now! Claim the full amount. I just got my letter through from their solicitors saying they accept the terms of my acceptance letter. They'd stipulated that I'd have to agree to confidentiality but I sent a letter back saying I agree to not pursue the claim and accept the amount but no way will I agree to confidentiality.

I filed my claim in the county court, paid the fees and then got a snotty letter off alliance and leicester saying that they dispute the whole amount and would see me in court. Today what comes through the letter box - a cheque for the full amount :D

also included at the bottom was a lovely little note implying that they're gonna close my account :D, oh well stuff em

The letter confirming they had received my complaint was dated 21st March (though it will have got to me a little later than that) and then I got this letter today. So you should get yours any time now basically :)

Not sure what to do now :?

if there 14 days are up take them to court, its a piece of piss to file a claim, you can do it online and once you've done this they will take you seriously, A&L didn't want to pay back my charges, i filed a claim, they sent a letter saying that they would fight me in court then a few days later a cheque for the full amount comes through the door 8)

Matt, it will be a putt off/stalling tactic. Just carry on as you were. I had a load of guff from HSBC telling me that I'd agreed to the T&Cs in their agreement so they were acting legally.

I just ignored it and ploughed on. Try the following link for some top advice, that helped me through every stage.

Who do you bank with at the moment then mate? I wouldn't worry to much about losing your account, as I'm pretty sure you can probably be getting a better deal elsewhere.

Just convenience really mate. I've got another few accounts with them, and I use the online banking to transfer from one to the other all the time.
