View Full Version : Anyone know about legal stuff - small claims - personal case

Without going into detail - someone owes me money and I want it back. It's been over 7 months since they've owed it me, and have promised to set up standing orders to pay me back each month and that hasn't materialised either.

They have no qualm in admitting they owe me this cash, but I have very little in writing to prove it, other than credit card statements in my name with some of the details of the stuff they bought

Anyone have any advice?

I think you can go to the small claims court, but from what I remember of a uni flat mate and his g/f you won't get anywhere if the other party doesn't turn up.

I don't know the full ins and outs though really. I'll ask the g/f 'cos her dads a solicitor.

Hmmm, i have leant money to friends and i am lucky that payments are usually made every month without fail (maybe something to do with my size).

If they are a friend i would be diplomatic and try to come to a written arrangement. State that you want 'X' amount of money by 'X' date and then 'X' amount every calender month from then on.

Maybe you should try to talk to them, and ask them why they wont pay. Try to reson that you need them to start paying.

Personally im not sure if you would be able to take legal action if you have little proof that they borrowed the money. And without a written agreement of repayments they are not legally obliged to pay back at set dates (if atall). They could claim the money was a present etc. Very difficult area.

At the end of the day you can only get someone to do something if they want to. You have to give them an incentive to pay. You will have to assess that person and see what motivates them. Put them in a position that they will be worse off if they dont pay. You can use either a carrot or stick, each will work equally well on different people. Im a carrot person and would probably respond well to a sob story and making me feel sorry for you. Some people are stick people and you have to threaten to break their legs.

One way to motivate them to pay maybe the treat hat unless they start to pay you back as of now in installments, you will expect a lump sum.

Recording them stating they owe you the money on a mobile phone surreptitiously placed in your pocket is another great trick coupled with solicitors threats.

I may as well post my situation on here, I doubt the other person will find or read it, though i'm not really arsed anymore if they do.

The money is owed to me by my ex. I was with him for 3 years and he borrowed and borrowed from me til i pretty much had enough. We were kinda civil to eachother after the split (i dumped him) and he promised me the money back, as he wasn't bitter etc.

Obviously now, 7 months later, i'm seeing someone else and he's seen his arse. I've asked him for the money and he said he was 'too skint' to pay me any. Then I found him arranging a trip to the Nurburgring in May on another forum.

I text him and again asked for the money as he obviously wasn't as skint as he made out and he said i'd have to wait til he was ready to pay me back!

I sent another txt on Friday, another polite message asking when he was able to start paying me back and he ignored it, so i sent an email to both him and his mum. This is the email I sent:

Trevor,

I'm writing this email as I do not seem to be getting any straight answers from you regarding the £1300 (plus all the interest that has been gathering on the cards for the last 7 months) you owe me. I know things didn't turn out for the best, but you promised the money back to me after you used my credit cards to buy all the parts for your car.

Please respond to this email within 10 days and let me know how and when you plan on paying any or all of this money back, as the standing order of £50 a month you said you were going to set up hasn't materialised.

I hope you are taking this matter as seriously as I am, I do not want to involve the courts but if I am forced to I will

And this morning i got this reply by text: (word for word)

Niiice :( The days when I do tricks when you say jump are over. I may meet you for a beer if you buying however, and we can chat? Anyway, I hope you are otherwise doing well :) but you should remember that a little less Being A Complete Bitch works wonders with me

I really don't want to have to meet him and especially don't want to buy him a beer the cheeky tw@t!

Hmm. I'll let you know if I can glean any info. Might not be too easy as he generally doesn't like talking shop. And his other daughter has got engaged this w/e so he might be too busy crapping himself about where the money for that's coming from!

Otherwise I might ask a guy in the office whose wife is also a soliciotr (I think)

TBH, i think youve got more chance of seeing the dark side of the moon from Romford, than you have of getting that money back. Sorry to be blunt, but thats the truth.

If he wanted to pay you he would. If you want to get on with your life id just walk away and put it down to experience.

The only option other than that, as far as i can see is to threaten to take back the parts of the car that you legally own (as shown on the credit card statement). The threat of this may make him pay at the thought of having his car ripped apart by some local 'pikey' mechanic that you hire down the 'Georage and Dragon' car park for £100.

Its a MK1 astra turbo rally car - his absolute pride and joy. And i paid for the tyres and the adjustable suspension amongst other things.

I'd even get to work on it myself to get my parts back :lol:

Hi Kelly, my understanding is that for amounts of £5000 or less this matter can be dealt with through the small claims court. I believe this now to be quite quick, my advice is to ring the citizens advice bureau( its free legal advice) they will not only be able to tell you how you should proceed but how good your chances are. Prehaps when your ex gets a letter taking him to court he will pay you, anyway good luck.

PS KS is probably right, but sure as eggs is eggs, do nothing, get nothing , its up to you, how bad do you want this MONEY!! :twisted:

IMHO you don't stand a chance of getting this money back. He's obviously a muppet. Personally i'd write it off and put it down to experience. Saying that though you don't have to forget it.

Taking parts off his car sounds good. Slapping the shit out of him sounds even better.

If it was me i'd grip him up and give him 30 days grace. After that he'd be under no illusion I WOULD be back to see him and do untold damage to him and property. Its worked in the past on many occasions.

how about if he doesn't play ball you say he stole the parts. When the police ask you why you never mentioned it earlier blame the stress of the relationship etc, how he mentally abused you and only now have you had the courage to say anything. Then when you get the money back pay KS and Big HP that £100 to go get the parts back (it's not necessary at this point, but hell, life's a bitch!)

no way is he on there too!?!? I went on due to the large amount of people in my area with the stickers and found out that nearly every bloody modded car in Cheadle Hulme area resides there... madness!

Good idea Jesus. Go round his house and tell him he has 24 hours to pay you the money in full or you will inform the Police the parts were stolen. Tell him you have the credit card bill that proves you bought the parts. Tell the Police they were in the garage and when you broken up he just took them. :D

Even if you dont get the money back they will impound the vehicle if they have suspision to think it contains stolen parts. Tell him you know this and say its up to him.

OR

Wait for Gunner to get back from Spain (dosser) and get him to do it properly :wink:
